What is an occasional lease and why is it worth it?
An occasional lease is a special form of rental agreement that, unlike a regular agreement, gives the owner stronger legal tools in case of problems with the tenant.
The most common situations are:
- Non-payment of rent by the tenant
- Refusal to move out at the end of the contract
- Destruction in the apartment
Occasional lease provides that the tenant already at the stage of signing the contract:
👉 Voluntarily submits to execution (which in practice allows for faster eviction)
👉 Indicates the address to which he will move out if he has to leave the rented premises
👉 Presents the consent of the owner of this property to accept it in case of eviction
What documents are needed to sign an occasional lease?
When preparing an occasional lease, you need:
- Tenant’s statements on the designation of the premises to which he will move in the event of eviction
- A statement from the owner of this property that he agrees to allow the tenant to live there if necessary
- Declaration on voluntary submission to execution in accordance with Article 777 §1 item 4 of the Code of Civil Procedure – drawn up at a notary‘s office
Only with this set of documents can you safely sign an occasional rental agreement.
The process of signing an occasional rental agreement – step by step
📝 Step 1 – Find an additional address
The tenant must indicate the address of the apartment or house to which he will be able to move in the event of eviction. Written consent from the owner of that property is also needed.
✍️ Step 2 – Sign the statement of voluntary submission to execution
With these documents go to the notary. The tenant signs a statement of voluntary submission to execution, which is in the form of a notarial deed. This gives the landlord a viable tool for eviction without a lengthy court process.
🏠 Step 3 – Sign the occasional rental agreement
Only with all the required documents prepared can you sign an occasional rental agreement with the owner of the apartment you are renting.
What if the tenant has no address to indicate?
In practice, many tenants (especially foreigners from Ukraine or Belarus who are just settling in Poland) do not have the opportunity to indicate an additional address.
