What is occasional rental and why is it worth it?

Occasional rental is a special form of rental agreement that, unlike a regular agreement, gives the owner stronger legal tools in case of problems with the tenant.

It most often concerns situations such as:

  • Non-payment of rent by the tenant
  • Refusal to vacate after the contract ends
  • Damage to the apartment

Occasional rental stipulates that the tenant, at the stage of signing the agreement:

👉 Voluntarily submits to enforcement (which in practice allows for quicker eviction)

👉 Indicates an address to which they will move in case of the need to vacate the rented property

👉 Provides the owner's consent for them to stay in case of eviction


What documents are needed to sign an occasional rental?

When preparing for an occasional rental, you need:

  1. A statement from the tenant indicating the property they will move to in case of eviction
  2. A statement from the owner of that property consenting to the tenant's residence if needed
  3. A statement of voluntary submission to enforcement in accordance with art. 777 §1 pkt 4 of the Code of Civil Procedure – drawn up by a notary

Only with this complete set of documents can you safely sign an occasional rental agreement.


The process of signing an occasional rental agreement – step by step

📝 Step 1 – Find an additional address

The tenant must indicate the address of an apartment or house to which they can move in case of eviction. A written consent from the owner of that property is also required.

✍️ Step 2 – Sign the statement of voluntary submission to enforcement

With these documents, go to a notary. The tenant signs a statement of voluntary submission to enforcement, which takes the form of a notarial deed. This gives the apartment owner a real tool to carry out an eviction without a lengthy court process.

🏠 Step 3 – Sign the occasional rental agreement

Only after preparing all the required documents can you sign the occasional rental agreement with the owner of the rented apartment.


What to do if the tenant does not have an address to indicate?

In practice, many tenants (especially foreigners from Ukraine or Belarus who are just settling in Poland) do not have the ability to indicate an additional address.
